Critical Risk Issues Affecting Aircraft Lenders and Lessors

Webcast panelists reviewed the current state of the aviation industry and took an in-depth look at the impact of recent litigation on aircraft lenders and lessors.

The Act of State Defense states that every sovereign state is bound to respect the independence of every other sovereign state, and the courts will not sit in judgement of another government's acts done within its own territory.

On September 12, experts from Marsh and leading aviation-industry experts led a webcast discussion on the current state of the aviation industry and provided an in-depth look at the impact of recent litigation on aircraft lenders and lessors.

Statutory protections afforded to aircraft lenders and lessors have been seriously eroded by two recent cases. During this webcast panelists discussed the Florida Supreme Court’s decision in Vreeland v. Ferrer, and the Philippine Air Line case, and its progeny, and provided ways to address their implications. Panelists also covered the latest developments in pending lender litigation and solutions and strategies for managing the increased risks the industry faces.
